Non-admission of revision in high-value civil dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 7th Civil Senate dismissed the plaintiff's complaint against the non-admission of a legal appeal (Revision) to the Federal Court, thereby upholding the judgment of the 22nd Civil Senate of the Higher Regional Court of Frankfurt am Main and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerns a civil matter involving a high-stakes claim, evidenced by a subject matter value of approximately 2.6 million euros initially, which remained in force as the lower court's decision was affirmed by the BGH. The court declined to provide a detailed written reasoning for the dismissal under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, a procedural provision allowing such omissions when the explanation would not contribute to clarifying the prerequisites for admitting a legal appeal, effectively leaving the lower court's assessment of the absence of significant legal questions unchanged.
