Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the judgment of the Higher Regional Court of Brandenburg and leaving that decision in force; the plaintiff was ordered to bear the costs of the proceedings. The case involved a civil dispute where the plaintiff challenged the lower court's refusal to admit an appeal on points of law to the federal court, with a matter in dispute valued at up to €40,000. The BGH declined to provide a substantive written reasoning, relying on § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), as the explanation would not contribute to clarifying the criteria for admitting a revision, and the non-admission was deemed final under § 97(1) ZPO for cost allocation purposes.
