Waiver of reasoning for non-admission of revision under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s complaint against the non-admission of revision, leaving the decision of the Düsseldorf Court of Appeal in force and ordering the defendant to bear the costs of the appellate proceedings and those arising from the plaintiff’s side intervention, with a dispute value of €21,288.96. This procedural ruling concerned a non-admission application filed after a civil money claim judgment, challenging the refusal of the higher court to permit a further appeal to the BGH. The court invoked § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to waive a detailed legal reasoning, determining that such an explanation would not contribute to the clarification of the statutory prerequisites for admitting a revision.
