Admissibility of non-admission of revision complaint in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the defendant's complaint against the non-admission of a legal revision to the appellate court's judgment, resulting in the lower court's decision becoming final with the defendant bearing the costs of the appellate proceedings. The dispute, valued at €73,411.13, concerned a civil matter originally litigated before the Hanseatic High Court in Hamburg, where the appellate court refused to admit a further appeal to the supreme court. The court declined to provide a substantive reasoning for the dismissal, applying § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, on the grounds that such an explanation would not contribute to the clarification of the requirements for admitting a revision.
