Admission of civil revision requiring fundamental significance or uniform jurisprudence under German civil procedure
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiffs' complaint against the non-admission of revision, upholding the 9th Civil Senate of the Cologne Higher Regional Court's decision from August 10, 2023, and ordering the plaintiffs to bear the costs of the complaint proceedings. The dispute concerned a civil matter where the plaintiffs challenged the appellate court's refusal to allow an appeal to the BGH, asserting that the case involved issues of fundamental significance, the need for legal development, or the securing of uniform jurisprudence. The court determined that the case met none of these statutory criteria for revision admission under § 543(2) sentence 1 ZPO and, per § 544(6) sentence 2 half-sentence 2 ZPO, declined to provide a detailed reasoned decision. Additionally, the court examined and rejected the plaintiffs' constitutional claims regarding the right to be heard under Art. 103(1) GG, while noting a dispute value of up to €140,000.
