Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiffs' complaint for non-admission of revision, thereby upholding the appellate court's decision from November 8, 2022, and leaving the lower court's judgment in force; the court declined to provide a written justification for this dismissal pursuant to § 544(6) Sentence 2, second half-sentence, German Code of Civil Procedure (ZPO), finding such a justification would not contribute to clarifying the prerequisites for admitting revision, while ordering the plaintiffs to bear the costs of the complaint proceedings. The dispute concerned a civil matter with a statutory value in dispute of €65,000, where the plaintiffs sought to challenge the appellate court's refusal to allow the appeal on points of law. The decision rests on the procedural doctrine that a court may omit the reasons for dismissing a non-admission complaint if those reasons would be ineffective for legal clarification, based strictly on the procedural provisions of the ZPO.
