BGH refuses to state reasons for dismissing complaint against non-admission of revision; cost allocation under § 97(1) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the judgment of the Second Civil Senate of the Higher Regional Court of Oldenburg dated July 12, 2022, in force; the defendant bears the costs of the complaint proceedings, and the disputed value was set at 174,327.44 euros. The case involved a civil dispute where the defendant sought to challenge the lower court's decision to refuse leave for a further appeal to the federal level. The court explicitly declined to provide a substantive reasoned opinion, citing § 544(6) Sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), on the ground that such an explanation would not contribute to clarifying the prerequisites for admitting a revision.
