The Federal Court of Justice dismissed the plaintiff’s complaint against the non-admission of revision, rejecting the appeal and ordering the plaintiff to bear the costs of the appellate proceedings, thereby leaving the judgment of the Higher Regional Court of Cologne intact. The dispute concerned a civil matter with an amount in controversy of 311,096.59 euros, wherein the plaintiff challenged the lower court’s refusal to allow a constitutional appeal based on perceived legal errors. The court decided that no substantive reasoning was necessary for the dismissal because such reasoning would not contribute to the clarification of the requirements for admitting a revision, pursuant to Section 544(6) Sentence 2, Second Half-Sentence of the Code of Civil Procedure (ZPO), which permits the court to dispense with an explanation when it does not advance legal certainty.
