Discretionary waiver of justification for dismissing complaint against non-admission of revision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, thereby upholding the prior appellate decision and leaving the lower court judgment in force, with the defendant ordered to bear the costs of the proceedings, including those incurred by an ancillary intervenor. The dispute concerned a civil matter where the defendant sought to challenge a judgment from the Court of Appeal, but the higher court declined to review the case on the merits. The decision was issued without a substantive justification, as the court determined that providing reasons would not contribute to clarifying the prerequisites for admitting a revision under § 544 Abs. 6 Satz 2 ZPO.
