Admissibility of non-argumentation for complaint against non-admission of revision under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of a revision appeal, thereby upholding the appellate decision of the Oberlandesgericht München and leaving the lower court's judgment final. The dispute arose from a civil matter where the defendant sought to challenge the admission of a revision appeal after the appellate court had refused to do so, with a litigation value of €41,650. The court denied the complaint without providing a substantive written rationale, expressly noting under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO that a justification would not contribute to the clarification of the conditions under which a revision appeal is admissible; the defendant was ordered to bear the costs of the complaint proceedings.
