Omission of reasoning on complaint against non-admission of revision under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby leaving the lower court's decision in force and ordering the defendant to bear the costs of the complaint proceedings, with a subject matter value of €30,026.14. The dispute arose in a civil matter before the 12th Civil Senate of the OLG Bamberg, where the defendant attempted to challenge the denial of their right to appeal the case to the highest instance. The court rejected the complaint without providing a detailed written reasoning, relying on the doctrine that a justification was unnecessary as it would not contribute to clarifying the prerequisites for admitting a revision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, while the cost allocation was based on § 97 Abs. 1 ZPO.
