The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of a revision appeal, thereby leaving the judgment of the 21st Civil Senate of the Kammergericht from April 18, 2023, in force and upholding the prevailing position of the opposing party; the court ordered the plaintiff to bear the costs of the complaint proceedings and set the value in dispute at €24,974.81. The dispute concerned a civil matter where the plaintiff sought to challenge the lower court's decision through an appeal to the BGH by arguing that the Kammergericht had failed to allow a revision appeal, but the BGH declined to provide a reasoned decision as such reasoning would not contribute to clarifying the conditions under which a revision is admissible. The decisive legal basis was § 544 Abs. 6 Satz 2, 2nd half-sentence of the Code of Civil Procedure (ZPO), which permits omitting a justification for dismissal if it does not aid in defining the prerequisites for admitting a revision, alongside § 97 Abs. 1 ZPO regarding the allocation of procedural costs.
