Denial of admission of revision in civil proceedings due to lack of contribution to legal clarification under § 544 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-admission of revision against the judgment of the Schleswig-Holstein Higher Regional Court, leaving the lower court's decision in force and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerned a civil matter with a value in dispute of €142,813.30, where the plaintiff challenged the initial court's refusal to allow an appeal to the supreme level. The BGH refused to provide a substantive written reasoning, citing that such an explanation would not contribute to clarifying the prerequisites for admitting a revision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, and imposed the costs based on §§ 97 Abs. 1 and 101 Abs. 1 ZPO.
