Waiver of reasoning for rejected non-admission complaint; absence of revision-clarity contribution under ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal on points of law, upholding the decision of the Regional Court of Appeal Düsseldorf and ordering the plaintiff to bear the costs of the appellate proceedings. The dispute concerned a civil matter with a subject matter value of €105,876.76, where the plaintiff challenged the lower court's refusal to allow a revision. The court decided without providing a detailed written reasoning, pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, on the ground that such a reasoning would not contribute to clarifying the conditions under which an appeal on points of law is to be admitted.
