BGH denies reasoning for dismissed non-admission of revision; costs allocated to appellant under ZPO §§ 544(6), 97(1), 101(1)
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the judgment of the Kammergericht and leaving it in force; the defendant incurred the costs of the complaint proceedings. The dispute involved a civil matter with a subject matter value of €50,000, where the defendant challenged the lower court's refusal to permit an appeal to the highest instance. The court declined to provide a written reasoning, determining that such an explanation would not contribute to clarifying the prerequisites for admitting revision, pursuant to § 544(6) Sentence 2, second half-sentence of the Code of Civil Procedure (ZPO).
