The Bundesgerichtshof (7th Civil Senate) dismissed the defendant's complaint against the non-admission of a revision appeal, thereby upholding the final judgment of the Cologne Higher Regional Court, VII Civil Senate, dated December 15, 2022, and ordering the defendant to bear the costs of the appellate proceedings, while the amicus curiae on the defendant's side bore its own costs. The dispute concerned a civil matter with a contested value of €209,427, in which the defendant attempted to challenge the regional court's decision but failed to meet the threshold for granting leave to appeal. The court declined to provide a written justification for the dismissal pursuant to Section 544(6), sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), as such reasoning would not contribute to clarifying the conditions under which a revision is admitted, with the procedural costs allocated according to Sections 97(1) and 101(1) ZPO.
