BGH rejects reasoning for refusal to admit revision in civil dispute under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision by the Brandenburg Higher Regional Court, thereby upholding the lower court's decision and leaving it in force; the plaintiff, who also bears the costs of the complaint proceedings including those arising from the defendant's auxiliary intervention, prevails in the procedural outcome as the defendant. The dispute involved a civil law matter where the plaintiff sought to appeal the lower court's judgment, but the BGH declined to grant admission to revision. The court relied on § 544 Abs. 6 Satz 2, 2nd half-sentence ZPO, abdicating from providing a detailed written reasoning because it would not contribute to clarifying the prerequisites for admitting revision, and applied §§ 97 Abs. 1 and 101 Abs. 1 ZPO for cost allocation.
