The Federal Court of Justice (BGH) rejected the defendant's complaint against the denial of leave to appeal a decision by the Dresden Higher Regional Court, leaving the lower court's denial in force and ordering the defendant to bear the costs of the proceedings, with a value in dispute of €68,420.63. The case involved a civil dispute where the defendant failed to establish sufficient grounds for a Supreme Court review following the OLG Dresden's refusal to permit a Revision in April 2024. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, waiving the written reasoning for the rejection because the decision was not deemed suitable for clarifying the prerequisites under which a Revision should be granted, thereby upholding the procedural outcome against the appellant.
