Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the order of the Munich Higher Regional Court and leaving the lower-court judgment in force. The dispute concerned a civil claim with a value in dispute of €91,057.50, where the plaintiff attempted to challenge the appellate court's decision refusing to grant leave for a constitutional-level review. The court relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting a written justification for a complaint decision if such reasoning would not contribute to clarifying the prerequisites for admitting revision, and assigned the costs of the complaint proceedings to the plaintiff pursuant to § 97 Abs. 1 ZPO.
