Waiver of reasoned decision in complaint against non-admission of revision due to lack of clarifying contribution
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the complaints against the non-admission of revision filed by the plaintiff and the third-party defendant, thereby upholding the lower court’s judgment and leaving the appeal unresolved; the plaintiff was ordered to bear one-tenth and the third-party defendant nine-tenths of the costs, with a matter in dispute valued up to €230,000. This decision concerned a civil proceeding in the 7th Civil Senate, specifically addressing the procedural requirements for admitting a revision appeal to the BGH. The court relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to refuse a reasoned decision, determining that one would not contribute to clarifying the prerequisites for admitting revision, and applied §§ 97 Abs. 1 and 100 Abs. 2 ZPO for cost allocation.
