Non-admission of revision: omitting reasoning for complaint against leave to appeal
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of leave to appeal, upholding the decision of the Oberlandesgericht Nürnberg which had previously refused to grant leave for revision; consequently, the lower court’s ruling remains in force, and the plaintiff bears the costs of the complaint proceedings. The dispute, valued at €50,000, involved a civil matter where the plaintiff attempted to challenge the appellate court's refusal to find issues of fundamental significance or serious defects in the lower court's decision. The decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, under which the BGH declined to provide a detailed reasoning for the dismissal, determining that such an explanation would not contribute to clarifying the prerequisites for admitting a revision, alongside § 97 Abs. 1 ZPO regarding cost allocation.
