Legislator-Zusammenfassung

The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the refusal to admit the revision appeal, thereby upholding the judgment of the Regional Court of Appeal in Zweibrücken and leaving it in final force, with the defendant bearing the procedural costs. The case, valued at up to €470,000, involved a civil dispute where the defendant challenged the lower court's denial of leave to appeal on grounds requiring the assessment of substantive legal issues, but the BGH found the complaint unmeritorious. The court relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to waive a detailed written justification, as such an explanation would not contribute to clarifying the conditions for admitting revision, and applied § 97 Abs. 1 ZPO to assign the costs of the complaint proceedings to the losing party.
