Dismissal of leave to appeal without reasoned judgment under § 544(6) Sentence 2, second half-sentence, ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the plaintiff's application for leave to appeal in revision against the Kammergericht's judgment dated January 12, 2024, thereby rendering the lower court's decision final and binding; the plaintiff was ordered to bear the costs of the appellate proceedings, and the court refrained from providing a detailed written reasoning as it deemed such an explanation unnecessary for clarifying the legal criteria for admitting revisions under § 544(6) Sentence 2, second half-sentence, of the German Code of Civil Procedure. The dispute, with a subject matter value of €277,240.66, concerned a civil matter where the plaintiff challenged the appeal court's ruling, but no substantive grounds for a constitutional or public interest exception to non-disclosure of reasoning were found. The decisive legal basis was the dismissal under § 544 Abs. 6 Satz 2 ZPO, coupled with the cost allocation rule in § 97 Abs. 1 ZPO.
