BGH refuses reasoned review of complaint against non-allowance of revision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Seventh Civil Senate dismissed the plaintiff's complaint against the non-allowance of revision, thereby upholding the finality of the lower appellate court's judgment in favor of the defendants. The dispute concerned a civil liability case where the plaintiff challenged the Higher Regional Court of Celle's decision not to admit an appeal to the BGH. The BGH refused to provide a reasoned decision, invoking the procedural provision that a detailed explanation would not contribute to clarifying the prerequisites for allowing revision. Consequently, the plaintiff bears the costs of the complaint proceedings, including those arising from the defendants' ancillary intervention, and the amount in dispute was set at 502,485.25 euros.
