Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) rejected the plaintiff's complaint against the refusal to grant leave for revision, thereby upholding the decision of the Munich Higher Regional Court and leaving the underlying judgment in force. The dispute involved a civil matter with a subject matter value of approximately €241,362, where the plaintiff sought to challenge the lower court's non-admission of an appeal on points of law. The court denied the complaint without providing a substantive reasoning, invoking its discretionary power to omit an explanation when it would not contribute to clarifying the conditions for granting leave for revision. The decision is based on § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), which permits the court to waive a reasoning statement in such non-admission proceedings.
