Non-admission of revision complaint: Justification for dispensing with reasoning under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH), 7th Civil Senate, dismissed the defendant's complaint against the non-admission of a revision appeal, upholding the decision of the Frankfurt Higher Regional Court and leaving that judgment in force; the defendant bore the costs of the complaint proceedings. The dispute concerned a civil matter involving a subject matter value of up to €550,000, where the defendant sought to challenge the lower court’s refusal to allow the appeal on points of law. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that a reasoned opinion would not contribute to clarifying the prerequisites for the admission of a revision, and thus dispensed with providing one.
