Waiver of reasoning for dismissal of complaint against non-admission of revision in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of a revision appeal, thereby upholding the decision of the Dresden Higher Regional Court and leaving the defendant in victory, with the plaintiff bearing the costs of the proceedings, including those resulting from a subsidiary intervention. The dispute concerned a civil matter valued up to €65,000, where the plaintiff sought to challenge the lower court’s refusal to allow a third-instance review. The court declined to provide a detailed written justification under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that such an explanation would not contribute to clarifying the prerequisites under which a revision is to be admitted.
