The BGH 7th Civil Senate dismissed the plaintiff's complaint against the non-admission of revision to the Federal Court of Justice, resulting in the finality of the Hamburg Higher Regional Court's judgment, with the plaintiff bearing the costs of the appeal proceedings and the amount in dispute set at €210,000. This procedural decision concerns a civil dispute where the appellant sought to overturn a lower court ruling, likely stemming from a breach of contract or tortious act given the high financial value, but the higher court declined to justify its refusal to admit the appeal as the grounds were insufficient to contribute to the clarification of the legal prerequisites for such admission. The decision relies on § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO) for omitting the substantive reasoning and § 97(1) ZPO for the allocation of litigation costs.
