The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision to the Higher Regional Court of Frankfurt am Main, thereby leaving the lower court's judgment in force and ordering the plaintiff to bear the costs of the complaint proceedings. The case involved a civil dispute with a subject matter value of €69,237.03, in which the plaintiff attempted to challenge the instance court's decision not to allow an appeal on points of law to the highest civil court. The decisive legal basis for the dismissal was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, under which the court waived a reasoned decision on the merits because providing one would not contribute to clarifying the prerequisites for the admission of revision.
