Refusal to permit revision in civil liability dispute; waiver of reasoning under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the refusal to permit revision, thereby upholding the lower court's final judgment in favor of the defendant. The dispute concerned a civil liability claim with a disputed value of approximately €72,918, where the plaintiff challenged the appellate court's decision not to admit a further appeal to the supreme court. The court declined to provide a detailed reasoning for the dismissal, citing that such an explanation would not contribute to clarifying the conditions for admitting revision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO. Consequently, the judgment of the Court of Appeal remains in force, and the plaintiff was ordered to bear the costs of the complaint proceedings, excluding the costs incurred by its assisting party.
