Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision by the Oberlandesgericht Düsseldorf, thereby leaving the lower court's decision final and upholding the plaintiff's victory in the underlying dispute; the case involved a civil liability matter with a subject matter value of approximately €183,462, where the defendant challenged the appellate court's refusal to allow further review; the BGH declined to provide a detailed written rationale, invoking § 544 Abs. 6 Satz 2 ZPO, on the ground that such a justification would not contribute to clarifying the prerequisites for admitting revision, and ordered the defendant to bear the procedural costs pursuant to § 97 Abs. 1 ZPO.
