The Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of appeal, leaving the lower court's judgment in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil matter where the plaintiff attempted to challenge the Oberlandesgericht's refusal to admit a revision (appeal on points of law) based on alleged deficiencies in the lower court's reasoning. The BGH rejected the complaint under § 544(6) Sentence 2, second half-sentence, and § 97(1) of the Code of Civil Procedure (ZPO), determining that a written justification for the dismissal would not contribute to clarifying the prerequisites for admitting revision, thereby upholding the procedural decision without substantive examination.
