Legislator-Zusammenfassung

The German Federal Court of Justice (BGH), 7th Civil Senate, dismissed the defendant's complaint against the non-admission of revision, thereby upholding the lower court’s judgment and leaving the defendant to bear the costs of the proceedings. The case concerned a civil dispute where the appellate court (Oberlandesgericht Frankfurt am Main) had rejected an appeal on the merits, and the defendant subsequently sought to have the appeal to the BGH allowed. The court ordered no written reasoning, as it determined that none would contribute to the clarification of the prerequisites for admitting a revision under Section 544(6) Sentence 2, second half-sentence of the Code of Civil Procedure (ZPO). The key legal basis for the decision was the discretionary exclusion of reasoning when such a justification is not suitable for elucidating the legal standards for revision admission, resulting in the finality of the prior instance's decision against the defendant.
