The German Federal Court of Justice (BGH) dismissed the appeals filed by the plaintiff and the opposing third party against the lower court's refusal to grant leave for revision, thereby upholding the appellate decision of the Koblenz Regional Court of Appeals; consequently, the judgment of the second instance remains in force. The dispute concerned a civil matter where both the plaintiff and the opposing third party challenged the procedural decision not to admit a constitutional or supreme court review, with a dispute value capped at €125,000. The court denied the appeals under § 544 Abs. 6 Satz 2 ZPO, explicitly forgoing a written justification on the grounds that it would not contribute to clarifying the prerequisites for admitting a revision, and allocated the court costs between the appellant and the opposing third party in the ratio of 6% and 94%, respectively.
