The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of a revision appeal, thereby leaving the Lower Regional Court of Oldenburg's judgment in force and ordering the plaintiff to bear the costs of the appellate proceeding. The dispute arose from a civil litigation process where the lower court had decided not to permit an appeal to the supreme court, prompting the plaintiff to seek review of that procedural decision. The court's ruling was based on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which exempts the court from providing a reasoned justification if such an explanation would not contribute to clarifying the prerequisites for admitting a revision, and on § 97 Abs. 1 ZPO for the cost allocation; the statutory value in dispute was determined to be up to €170,000.
