The Bundesgerichtshof (BGH) 7th Civil Senate dismissed the defendant's complaint against the non-admission of revision, thereby upholding the Kammergericht's decision and leaving the lower court's judgment in force. This procedural ruling concerns a civil dispute with a subject matter value of up to €950,000, where the defendant failed to demonstrate the prerequisites for a third-instance appeal. The court ordered the defendant to bear the costs of the complaint proceedings, including those incurred by the intervenor on the plaintiff's side, while the defendant's intervenor was ordered to bear their own costs. The decision was rendered without a substantive written justification under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such an explanation was deemed unnecessary for clarifying the conditions under which revision is admissible.
