Legislator-Zusammenfassung

KI-generiert

The Federal Court of Civil Procedure (BGH) 7th Civil Senate dismissed the plaintiff's complaint against the non-acceptance of revision, thereby upholding the decision of the Naumburg Higher Regional Court and finalizing the dismissal of the appeal; consequently, the lower court's judgment remains in force, and the plaintiff is ordered to bear the costs of the complaint proceedings. The dispute concerned a civil matter with a subject matter value of €4,152,907.75, where the plaintiff sought to challenge the lower court's refusal to grant leave for a further appeal on the ground that it raised questions of fundamental significance or significant divergence from previous case law. The decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, pursuant to which the court omitted a reasoned explanation because the decision was not suited to clarifying the prerequisites for the admission of revision, as the complaint failed to demonstrate the requisite procedural defects or legal errors sufficient to justify federal court review.
