The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of a revision appeal, leaving the judgment of the Bamberg Higher Regional Court dated March 2, 2023, in force; the plaintiff, who bears the costs of the complaint proceedings, did not prevail. The dispute, valued at €63,296.98, involved a civil law matter previously adjudicated by the 12th Civil Senate of the Oberlandesgericht, where the plaintiff sought to challenge the lower court's decision through a constitutional-level appeal but failed to justify the admission of a further instance. The court ordered a dismissal without substantive reasoning pursuant to § 544(6) sentence 2, second half-sentence, and § 97(1) of the German Code of Civil Procedure (ZPO), as such reasoning was deemed unsuitable for clarifying the prerequisites for admitting a revision appeal.
