Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-acceptance of appeal by the Munich Higher Regional Court, thereby upholding the lower court's decision and leaving the defendant to bear the costs of the proceedings, with a value in dispute of €26,660. This decision arises from a civil dispute where the defendant challenged the 28th Civil Senate's refusal to allow a revision appeal, though the specific subject matter is not detailed in the procedural order. The BGH explicitly declined to provide a substantive justification for the dismissal, applying § 544 para. 6 sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), on the ground that such an explanation would not contribute to clarifying the prerequisites for admitting a revision appeal, while the cost allocation was based on § 97 para. 1 ZPO.
