Admission of revision: BGH denies substantive justification for dismissing non-acceptance complaint under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s non-acceptance complaint against the appellate court’s refusal to allow revision, thereby upholding the final judgment of the 11th Civil Senate of the Oberlandesgericht Köln; the defendant bore the costs of the complaint proceedings. The dispute concerned a civil matter with a subject matter value up to €230,000, where the defendant challenged the admission of a revision appeal against the lower court's decision. The court declined to provide a substantive written justification for the dismissal, citing § 544 Abs. 6 Satz 2 ZPO, as such an explanation was deemed not conducive to clarifying the preconditions for admitting a revision.
