Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Civil Justice (BGH) dismissed the defendant's complaint against the non-admission of an appeal to the federal court, thereby upholding the judgment of the Saarländischer Oberlandesgericht and leaving the lower court's decision in force; the defendant bears the costs of the appellate proceedings. The dispute, valued at €41,738.76, involved a civil matter where the lower court declined to allow an appeal on the ground that the case lacked the requisite legal significance for federal review. The BGH's decision relied on § 544(6) Sentence 2 Second Half-Sentence of the German Code of Civil Procedure (ZPO), which permits omitting the reasoned judgment for such dismissals when it would not contribute to clarifying the prerequisites for admitting an appeal to the federal court, and on § 97(1) ZPO for the cost allocation.
