Denial of leave to file a revision appeal; omission of grounds under § 544(6) Sentence 2 Second Half-Sentence German Code of Civil Procedure
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff’s non-appealable complaint against the denial of leave to appeal, thereby upholding the judgment of the Oberlandesgericht Naumburg of 17 January 2024; the plaintiff, who bore the costs of the proceedings, prevailed on no issues. The dispute concerned a civil matter with a subject matter value of €22,895.60, where the plaintiff sought to challenge the lower court’s refusal to admit a revision appeal. The court denied a reasoned decision, applying § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting the reasoning if it would not contribute to clarifying the conditions for admitting a revision; the decision relied on § 97 Abs. 1 ZPO for the allocation of procedural costs.
