Discretion to omit reasoned decision in non-admission of revision complaint under § 544(6) No. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of the legal appeal (Revision), thereby leaving the judgment of the Higher Regional Court of Düsseldorf of February 24, 2022, in force and ordering the defendant to bear the costs of the complaint proceedings. The dispute concerned a civil matter with an amount in dispute of €449,166.65, in which the defendant challenged the appellate court's refusal to allow the case to proceed to the highest court on appeal. The decision was rendered without a reasoned opinion pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as the court determined that a reasoning would not contribute to clarifying the prerequisites for admitting a Revision, applying the procedural cost rules of § 97 Abs. 1 ZPO.
