Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiffs' complaint for leave to appeal, thereby upholding the appellate court's refusal to permit a revision and leaving the prior procedural decision in force; the plaintiffs bear the costs of the complaint proceedings, excluding costs caused by a third-party intervener on their side. The dispute, valued at €350,000, concerned a civil matter where the plaintiffs challenged the OLG Schleswig-Holstein's denial of leave to appeal, and the case involved a significant claim amount indicating a substantive civil controversy. The BGH refused to provide a detailed reasoning for its decision, invoking the provision that a summary is omitted when it would not contribute to clarifying the conditions for the admission of an appeal, as permitted by § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO.
