Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, rejecting the request without detailed reasoning as it would not contribute to clarifying the prerequisites for admission under § 544 Abs. 6 Satz 2 ZPO; consequently, the judgment of the Kammergericht (7th Civil Senate) dated April 28, 2023, remains in force, and the plaintiff bears the costs of the complaint proceedings. The dispute involved a civil litigation matter with a subject matter amount of €324,664.61, where the appellate court had refused to allow a further appeal to the supreme court. The decision is based on the procedural provisions of the German Code of Civil Procedure regarding the admissibility of revision appeals and the allocation of legal costs, specifically §§ 544 and 97, 101 ZPO.
