Civil procedure: Waiver of reasoning for complaint against non-admission of revision under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, leaving the lower court's decision in force and ordering the defendant to bear the costs of the complaint proceedings. This procedural ruling arose from a civil dispute where the defendant attempted to challenge the Munich Higher Regional Court's refusal to allow an appeal on points of law. The court explicitly declined to provide a written reasoning, citing that such an explanation would not contribute to clarifying the prerequisites for admitting a revision under Section 544(6), Sentence 2, Second Half-Sentence of the Code of Civil Procedure.
