The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of an appeal to the court of revision, thereby upholding the lower court's decision and leaving the initial judgment in force; in doing so, the court denied the plaintiff's request and ordered them to bear the costs of the proceedings, including those incurred by the intervenor. The dispute arose in a civil case valued at approximately €256,302, where the plaintiff sought to overturn a second-instance ruling by the 14th Civil Senate of the Hanover Regional Court of Appeals. The decisive legal basis was § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), which permits the court to omit a substantive justification for the dismissal of the complaint if such an explanation would not contribute to clarifying the conditions under which a revision appeal is admissible.
