Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff’s complaint for lack of admission, rejecting his request to review the lower court’s judgment; consequently, the ruling by the appellate court stands, and the plaintiff is ordered to bear the costs of the complaint proceedings. The dispute concerned a civil liability matter where the plaintiff challenged the appellate court’s refusal to allow a revision appeal, with the subject value capped at €30,000. The court’s decision rested on § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure, which permits omitting a reasoned explanation when such a justification would not contribute to clarifying the prerequisites for admitting a revision.
