Dismissal of complaint for lack of contribution to clarification of appeal admission prerequisites in labor law dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the lower court's refusal to permit an appeal on points of law, resulting in the appeal proceedings being terminated and the judgment of the Higher Regional Court of Munich from April 14, 2022, taking effect as final; the plaintiff was ordered to bear the costs of the complaint proceedings. The dispute arose from a civil matter where the plaintiff failed to meet the statutory threshold for granting leave to appeal to the supreme court in a commercial law case valued at approximately 21,000 euros. The court applied Section 544(6) Sentence 2 of the Code of Civil Procedure, specifically the second half-sentence, to waive the requirement for a written reasoned decision, as such an explanation would not contribute to clarifying the prerequisites for admitting an appeal on points of law.
