Denial of leave for revision without substantive reasoning under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) rejected the defendant’s non-admission complaint against the denial of leave to appeal, thereby allowing the lower court’s judgment to stand in force and leaving the defendant with the costs of the appellate proceedings. The dispute concerned a civil matter where the defendant sought to challenge the appellate decision rendered by the 21st Civil Senate of the Oberlandesgericht Frankfurt am Main, failing to meet the requisite standards for granting leave for revision. The court explicitly waived providing a substantive legal reasoning, relying on the procedural rule that a justification was deemed unnecessary as it would not contribute to clarifying the conditions for admitting a revisionary appeal, citing §§ 544 Abs. 6 Satz 2, 2. Halbsatz and § 97 Abs. 1 ZPO as the decisive legal basis for the dismissal and cost allocation.
